Parking Contract

Place2Park.co.uk is a parking space rental agency Website which provides an (“Online Service”) connecting owners who have parking spaces or charging points with those seeking parking and/or charging. These Terms and Conditions form part of the Terms and Conditions for use of the Online Service. This section specifies the (”Contract”) between two users of the Online Service provided by Place2Park. By continuing to use the Online Service, you accept these terms and conditions of the Contract.

Drivers

In the (“Parking Contract”) we refer to individuals who use the Online Service to pay for parking as (“Drivers”) even if the person who pays to park is not the Driver of that vehicle using the space.

Space Owners

In the Parking Contract we refer to individuals or businesses who advertise parking spaces using the Online Service as (“Space Owners”).

The parties to this Parking Contract

These terms and conditions set out the (”Contract”) between: a person who uses the Online Service to book, and pay for a parking space (“the Driver”); and a business or person who uses the Online Service to advertise a parking space for rent (“the Space Owner”) when a Driver uses the Online Service to make a booking with the (“Space Owner”).

Our role in the Parking Contract

We are not party to Parking Contact. This is a contract between the Driver and the Space Owner. We are authorised by the Space Owner to act as the Space Owner's agent to create a binding contract with Driver’s that pay to park at a Space Owner's parking space through the Online Service. While we are not part of the Parking Contract, we are still entitled to exercise specified rights under the Parking Contract in our own rights, where expressly stated.

How The Parking Contract is formed

The Parking Contract becomes legally binding between the Driver and the Space Owner when we confirm the Booking and receive payment from the Driver.

No reliance on anything outside the Parking Contract

The Driver and the Space Owner agree that the Parking Contract contains the whole agreement between both parties and each party acknowledges that they have not relied upon any other information (written or verbal) made by the other in entering into the Parking Contract, other than the Space Owner's listing description included in the advertisement.

Driver’s Obligations

By entering into this Parking Contract through our Online Service, you agree to observe and act in accordance with this Contract, and confirm that you:

  • will not use the Parking Space or deal with the Space Owner in any way which could be deemed to be harmful to the business or reputation of Place2Park;
  • you agree that you will not create any false account with Place2Park or use your account for any immoral or illegal activity or purpose including (without limit) malicious or fraudulent bookings or money laundering;
  • you agree to use the Parking Space in line with any other requirements specified in the booking confirmation. This could include using only specified parking bays if applicable, collecting any required permit from the Space Owner etc. These details will be provided in the Booking Confirmation email;ed in and have held and the associated payment methods used.
  • you agree to park only the vehicle confirmed on the booking. If the Driver wishes to change the registered vehicle to be used for the parking space, the Driver must get in touch with us, so that we can notify the Space Owner, and the obligation not to park any vehicle other than the one confirmed on the booking will continue until we have notified the Driver that we have confirmed the change of vehicle;
  • you agree that you have primary responsibility for your own safety and the safety of your vehicle during the Booking. The Space Owner is not responsible for ensuring the safety of you or your vehicle.

In relation to your Booking with the Space Owner you also agree to:

  • keep the Parking Space clean, tidy and clear of rubbish and leave the Parking Space in the same condition as you find it;
  • not conduct any illegal or immoral activity from the Parking Space;
  • not conduct any business or commercial activity whatsoever from the Parking Space; and;
  • not use the Parking Space for any purpose other than for parking;
  • to provide us with a minimum of 30-days’ notice from the billing date to end a booking; and
  • to vacate the parking space and cease using the parking space at the end of the time specified, and to authorise us to collect on behalf of the Space Owner any payment due for any additional times used, such payment to be collected by way of deduction from the deposit paid by the Driver or using the credit or debit card details supplier by the Driver when booking the parking space;
  • to return any / and all access equipment provided for the booked parking space to the Space Owner, and to authorise us to collect payment on behalf of the Space Owner for the full cost of replacement of any access equipment which is not returned, such payment to be collected by way of deduction from the deposit paid by the Driver or using the credit or debit card details supplied by the Driver when booking the parking space.
  • You acknowledge that the Parking Space is someone else's property and you agree not to access any other part of the property (of which you don’t need to) to which the Parking Space is attached.

Driver's rights

The Driver has the following rights under the Parking Contract:

  • to park the vehicle confirmed for the booking at the parking space booked, and at the times specified (if any) on the space listing; or
  • to allow another person to park the same vehicle at that parking space at the specified times (if there are any).

Space Owner’s Obligations

As a Space Owner you agree to:

  • provide your Parking Space in accordance with the details and information set out in your listing on our Platform;
  • ensure that the Parking Space is clean, tidy and clear of rubbish at the start of the Booking and that any equipment provided as part of the Booking (including, for example electric vehicle charging equipment ) is in good working order;
  • deal with all Drivers in a professional and courteous manner and in such a way as to not cause any harm or damage to our reputation;
  • not deliberately do, or omit to do, anything which will or is likely to put the Driver or their vehicle at risk;
  • not obstruct the Driver or prevent the Driver from parking in the Parking Space and not allow any vehicle, other than the vehicle detailed in the Booking to use the Parking Space;
  • honour all bookings with Drivers and ensure that the Parking Space (and electric vehicle charger, if applicable) is available for the whole duration of the Booking;
  • to provide a minimum of 30 days’ notice to end a booking as a single Space Owner, or a minimum of 3 months’ notice as a Space Owner with multiple bookings. A £30.00 per booking early termination fee will apply for any notice period less than the minimum required days or months;
  • to comply with all applicable laws and rules and regulations that may apply to the parking space, including but not limited to any relevant rules, zoning laws and laws governing rental of or licenses to use the relevant property;
  • to provide us with any claim to the deposit paid by the Driver for the cost to replace unreturned or damaged access equipment provided for the booking, up to the value of the deposit held, in writing and within 5-days of the end-date of the booking;
  • If your listing includes electric vehicle charging facilities, you ensure that these are fully functioning and maintained as per the manufacturer's instructions. You also agree to cover any and all electricity costs consumed by a Driver as a result of the usage of the charger.
  • You agree that you will not create any false account with Place2Park or use your account with Place2Park for any immoral or illegal activity or purpose including (without limit) malicious or fraudulent bookings or money laundering

Space Owner's rights

Under the Parking Contract the Space Owner is entitled to receive the payments made by the Driver (or Driver’s) for each Parking Space and/or charging point booking through the Online Service, minus the fees we add to the Driver's total price for our services.

Payment

We are authorized by the Space Owner to accept payments from Driver’s for booking their parking space and/or charging point through the Online Service. When Driver’s make a long-term booking (any booking of more than 30 days) we will also take a deposit payment from the Driver to the value of one month's rental payment for use of the parking space at the time the booking is made to cover any access equipment, permits handed out and the parking space. The deposit payment is refundable at the end of the booking, provided there are no outstanding amounts due to the Space Owner and any access equipment or permits provided are given back to the Space Owner in full working order. We will then collect the first month’s payment for parking on the first day of the booking period, and will collect subsequent payments for each month in advance on the same day of the calendar month during each subsequent month for the duration of the booking. Under this Agreement if the Driver disputes a payment for an active booking with their bank, a £12.50 administration fee will be applied to the booking.

Booking confirmation email

Once we have received payment from the Driver the booking will be confirmed, and we will send a booking confirmation email to both the Driver and the Space Owner informing them of the booking, which will include the full details of the booking.

Collection of payments due

All bookings made are subject to the Cancellation Policy below and both the Space Owner and Driver agree to comply with the terms of the Cancellation Policy, and to authorise us to administer the Cancellation Policy by making refunds where applicable.

Cancellation by the Driver

If the Driver wants to cancel a booking for parking they will be able to cancel any time before the date of which the booking / parking session is due to start and by the end of the second day of the booking / parking session to be entailed to a full refund* (less the cost of each day of the parking session until the end of the day after the day on which we receive your email to cancel). If the Driver fails to cancel the booking by notifying us after these times stated, the Driver will be liable for the full amount of the fees payable for the booking and will not receive any refund, even if the Driver does not use the parking space.

Cancellation by us or by the Space Owner

The Driver agrees that if either we or the Space Owner wish to cancel a booking, we may do so, on our own behalf or acting on behalf of the Space Owner, through our Online Service in accordance with this Cancellation Policy.

If the parking space is not available

If the parking space is not available before the booking we will inform the Driver of this and offer the Driver a different space, or a full refund. If the space is not available any time during the booking, please get in touch with us on booking@place2park.co.uk.

The Space Owner's obligations in respect of cancellation

The Space Owner must inform us immediately if they wish to cancel a booking, and authorises us to collect any payment if any refund is due to the Driver in accordance with this cancellation policy, by deducting the value of any such refunds from amounts which would otherwise be due to the Space Owner.

Refunds paid as agent for Space Owner

We will pay any refund to which the Driver may be entitled, acting as agent on behalf of the Space Owner. The Space Owner has no authority or means to issue any refunds at all.

Electric vehicle charging

The Driver must follow all user instructions in relation to the use of an electric charge point. It is The Driver’s responsibility to ensure that the charging of your vehicle using a charge point is carried out safely so as to avoid injury to any person or damage to property. In particular, this includes but is not limited to ensuring that you take all reasonable care when charging your vehicle and that:

  • you have all necessary connector cables to enable your vehicle to be charged at a charge point;
  • the connector cable must not create a tripping hazard to any person around.
  • You will be responsible for any damage caused to a charge point, any other property or for any injury to any person due to a breach of these terms, or failure to comply with any user instructions or guidance in relation to a charge point and/or your vehicle.

General

If a court finds part of these terms illegal, the rest will still continue in force

Each of the paragraphs of these terms operates separately and you agree that these terms are fair and reasonable in all circumstances. However, if any part of these terms is disallowed or found to be ineffective by a court or relevant authority the other provisions shall continue to apply.

No transfer of the Parking Contract

Neither party to the Parking Contract may transfer its rights or obligations to another person or business.

Governing Law and Jurisdiction

These terms are governed exclusively by English law. We both agree to submit to the non-exclusive jurisdiction of the English courts, which means if you live in any other jurisdiction which gives you mandatory consumer protection rights, you may enforce your rights in connection with these terms in the EU member state in which you live or if you live in any other jurisdiction which gives you mandatory consumer protection rights, you may enforce your rights in connection with the terms, in accordance with such rights.
